§1 Scope and Provider

These general terms and conditions apply to all orders that consumers (§ 13 BGB) submit on the online store of EDC Concept GmbH, Waldenauer Marktplatz 13, DE 25421 Pinneberg, GF: Axel Kollhof (hereinafter Dice Up – Onlineshop). A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either his commercial or his independent professional activity.

 

§2 Conclusion of contract

§2.1 The product representations in the online shop are used to submit a purchase offer. By clicking the button “Buy” you make a binding offer. The sale of our products is only for private use.

§2.2 We can accept your order by sending a separate order confirmation by e-mail or by delivery of the goods within 14 days. Confirmation of the receipt of the order is made by automated e-mail immediately after sending the order and does not constitute acceptance of an agreement.

 

§3 Prices

The prices quoted on the product pages include the legal value added tax and other price components for private individuals and exclude costs for shipping, insurance and payment. The prices for our business customers are exclusive of VAT and exclude shipping, insurance and payment.

§4 Shipping Costs

§4.1 The shipping costs depend on the shipping method you selected and the specific content of your order. There are different costs for the shipping methods offered by us in the online shop. These shipping costs depend on the destination country, the selected shipping method and the content of your order. In the shipping costs overview, which you can reach from the product pages and the shopping cart system, you will see the shipping methods offered in our shop with your conditions and costs. Individual products bring their own surcharge on the shipping costs. This surcharge is displayed on the product pages and in the shopping cart system. The total shipping costs will then be clearly communicated in the shopping cart system and on the order page. Possibly. incurred insurance costs can also be found in the shipping costs overview, the shopping cart system and the order page.

 

§5 Delivery Conditions

§5.1 Delivery will be made according to the shipping method chosen by you with the relevant shipping company.

§5.2 The delivery time is, unless otherwise stated in the offer, about 3-5 days.

§5.3 If not all products ordered are in stock, we are entitled to partial deliveries at our expense, as far as this is reasonable for you.

§5.4 If the delivery of the goods fail despite three delivery attempts, we can withdraw from the contract. Payments made will be reimbursed immediately.

§5.5 If the ordered product is not available because we are not supplied with this product by our suppliers without own fault, we can withdraw from the contract. In this case, we will inform you immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or if you do not wish to receive a comparable product, we will immediately reimburse you for any consideration already paid.

 

§6 Terms of Payment

§6.1 The payment is made either by the selected payment method.

§6.2 If you select the payment method in advance we will give you our bank details in the order confirmation. The invoice amount has to be transferred to our account within 10 days. If you pay by credit card or direct debit, your account will be charged with shipping the goods. When paying by Sofortüberweisung and payment via PayPal, the payment is made with sending the order.

§6.3 If you are in default of payment, the purchase price shall be charged during the default in the amount of 5% above the base rate. We reserve the right to prove and assert a higher damage caused by default.

§6.4 When paying by direct debit, you may have to bear any costs incurred as a result of a chargeback of a payment transaction due to insufficient funds or due to incorrectly transmitted bank details.

 

§7 Retention of Title

The goods remain our property until full payment. Before transfer of ownership, a pledge, transfer, processing or transformation without our consent is not permitted.

 

§8 Right of Withdrawal

§8.1 Consumers have a fourteen-day right of withdrawal.

Cancellation

Withdrawal: You have the right to withdraw from this contract within fourteen days without giving reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (EDC Concept GmbH, Waldenauer Marktplatz 13, DE 25421 Pinneberg, Phone 04101 8561500, E-Mail info@dice-up.com) by means of a clear statement (eg a letter sent by mail, fax or e-mail) about your decision to withdraw from this contract. You can use the attached model withdrawal form, which is not required. In order to maintain the cancellation period, it is sufficient that you send the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the Cancellation

If you withdraw from this Agreement, we have selected all payments we have received from you, including delivery charges (except for the additional costs arising from your choosing a different delivery method than the most favorable standard delivery we offer have to repay immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees. We may refuse to repay you until we have the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the immediate costs of returning the goods.

You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functionality of the goods.

§8.2 The right of withdrawal does not apply to delivery of goods,

– which are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is authoritative or which are clearly tailored to the personal needs of the consumer, for the supply of goods which may spoil quickly or whose expiry date would be rapidly exceeded,

– which, for reasons of health or hygiene, are not suitable for return if their seal has been removed after delivery,

– if, due to their nature, they have been inseparably mixed with other goods after delivery

– not even when sound or video recordings or computer software are delivered in a sealed package, when the seal has been removed after delivery,

– for the supply of alcoholic beverages, the price of which was agreed at the time of the conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose actual value depends on fluctuations in the market over which the entrepreneur has no influence.

 

§9 Transport Damages

§9.1 If goods are delivered with obvious transport damage, then please complain such errors immediately to the deliverer, and please contact us as soon as possible (telephone 04101 8561500)

§9.2 The omission of a complaint or contact has no consequences for your statutory warranty rights.
